Ikenga Imo Ugochinyere, the representative for Ideato North and South Federal Constituency in Imo State, was elected to the House of Representatives. This decision was upheld by the Appeal Court’s Lagos division.
The panel of the Appeal Court, presided over by Justice Abubakar Babandi Gumel, overturned the Tribunal’s decision to fire Ugochinyere.
Because there were no primaries in the Federal Constituency, the election petition tribunal at Mararaba High Court decided that Ugochinyere’s PDP was not a candidate for the election.

The tribunal that rendered the decision on September 10th also ordered the Independent National Electoral Commission, or INEC, to hold new elections between candidates from the APC and the LP in four wards.
Nonetheless, Gumel’s unanimous ruling on Wednesday overturned the tribunal’s rulings.
Gumel ruled that because the petition concerned a pre-election issue, the tribunals lacked jurisdiction to hear it.
