Cruz was charged with 17 counts of premeditated murder at his initial arraignment the day after the shootings and was jailed without bond. Cruz admitted to the shooting, according to a sheriff’s office affidavit. Cruz allegedly admitted to officers that he had concealed some extra loaded magazines in a backpack.

After the arraignment, Cruz was placed on suicide watch in a solitary confinement cell. Gordon Weekes, the lead defense attorney, requested that Broward Circuit Judge Elizabeth Scherer step aside, arguing that her prior remarks and decisions indicated prejudice toward the prosecution and would prevent Cruz from having a fair trial. On February 26, she rejected the request since she didn’t agree.
